These Terms & Conditions apply to all enquiries, quotations, bookings, inspections, dead animal removal, carcass removal, animal remains removal and related services provided by David's Dead Animal Removal ("we", "us", "our").

By requesting a quote, making a booking, accepting a quotation, making payment or allowing our technician or contractor to commence work, you agree to these Terms & Conditions.

1. Our Services

David's Dead Animal Removal provides services relating specifically to the identification, removal and appropriate disposal of dead animals and animal remains, where legally permitted.
Services may include:

  • Animal carcass removal
  • Dead animal collection
  • Removal of dead animals from accessible areas
  • Removal from yards and outdoor areas
  • Removal from roof spaces
  • Removal from ceiling spaces
  • Removal from garages
  • Removal from other accessible property areas

  • Disposal of animal remains where legally permitted

The exact service will depend on the type, size, location and condition of the animal remains.

2. Wildlife and Protected Animals

We will not knowingly undertake unlawful removal, handling or disposal of protected wildlife.
Where the animal may be a protected species or where specialised wildlife handling is required, we may recommend contacting an appropriately licensed wildlife professional or relevant authority.
The customer must provide accurate information about the animal where known.

3. Identification of Animal

In some circumstances, the exact species or cause of death may not be identifiable.
Our service is primarily concerned with removal and disposal and does not constitute veterinary diagnosis, forensic investigation or determination of the cause of death unless separately agreed and legally permitted.

4. Quotes and Pricing

Quotes may be based on information provided by the customer.
The final price may vary depending on:

  • Accessibility
  • Decomposition
  • Odour
  • Contamination
  • Required protective equipment
  • Required cleaning or sanitisation

Where the actual conditions materially differ from the information provided when booking, additional charges may apply after discussion with the customer where reasonably practicable.

5. Inspection

An inspection may be required before a final price can be confirmed.
If an inspection or attendance fee applies, the customer will be advised where reasonably practicable before the service is undertaken.

6. Difficult or Restricted Access

Dead animals may be located in:

  • Roof cavities
  • Ceiling cavities
  • Wall cavities
  • Under floors
  • Ducts
  • Crawl spaces
  • Confined spaces
  • Behind structures
  • Other restricted locations

We may require additional equipment, access or personnel.
If removal requires opening or damaging a structure, we will discuss the requirement with the customer before proceeding where reasonably practicable.
Structural repairs are not included unless separately agreed.

7. Health and Safety

Dead animals and decomposing remains can present health and safety risks.
Potential hazards may include:

  • Bacteria
  • Parasites
  • Bodily fluids
  • Decomposition
  • Contaminated materials
  • Sharp objects
  • Restricted spaces
  • Poor ventilation
  • Structural hazards
  • Other biological or environmental hazards

We may refuse or postpone work where the site presents an unacceptable safety risk.

8. Customer Responsibilities

The customer must:

  • Provide accurate information
  • Provide safe and lawful access
  • Inform us of known hazards
  • Keep children and pets away from the work area
  • Obtain permission from the property owner where necessary
  • Obtain strata, body corporate or landlord approval where required
  • Inform us if the property contains known hazardous substances or unsafe conditions

9. Removal and Disposal

Where legally permitted, we will remove and dispose of animal remains using reasonable and appropriate methods.
Disposal requirements may vary depending on:

  • Animal species
  • Local regulations
  • Location
  • Condition of the remains
  • Contamination
  • Disposal facility requirements

We do not guarantee that every animal can be removed or disposed of in the same manner.

10. Cleaning and Decontamination

Basic clean-up may be included where specifically stated in the quotation.
Deep cleaning, odour treatment, sanitisation, decontamination, insulation removal, structural repairs and restoration may require additional services and charges.
If animal remains have caused contamination, staining or persistent odour, complete restoration may not be possible without additional work.

11. Damage and Existing Conditions

We are not responsible for damage resulting from:

  • Pre-existing structural defects
  • Deteriorated materials
  • Hidden defects
  • Fragile structures
  • Existing damage
  • Unsafe access
  • Conditions not reasonably visible before work
  • Incorrect information provided by the customer

Where access requires opening a ceiling, wall or other structure, this will be discussed before work where reasonably practicable.

12. Cancellation and Rescheduling

A minimum of 24 hours' notice is required to cancel or reschedule a confirmed booking.
Cancellations or rescheduling requests made with less than 24 hours' notice may result in a call-out, cancellation or administration fee, as advised at the time of booking.

13. Call-Out Charges

A call-out charge may apply where:

  • The customer cancels on the day
  • Less than 24 hours' notice is provided
  • No authorised person is available
  • Access cannot be obtained
  • The animal cannot be located based on the information supplied
  • The customer declines the service after attendance
  • The site is unsafe
  • The service cannot proceed for reasons outside our control
  • The customer provided materially incorrect information about the location or condition

Any applicable charge will be communicated where reasonably practicable.

14. Emergency and After-Hours Services

Urgent, same-day or after-hours services may be subject to additional fees and availability restrictions.
Booking an urgent service does not guarantee a specific arrival time unless expressly confirmed.

15. Payment

Unless otherwise agreed, payment is due upon completion of the service.
Invoices must be paid within the payment period specified on the invoice.
Where permitted by law, reasonable costs associated with recovering overdue amounts may be recoverable.

16. Complaints

Customers should contact us as soon as possible if they have concerns about a service.
We will reasonably investigate complaints and, where appropriate, provide an opportunity to inspect the issue.
Nothing in these Terms limits rights that cannot legally be excluded under the Australian Consumer Law.

17. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any rights or consumer guarantees that cannot legally be excluded under Australian law.
Where applicable, services will be provided with reasonable care and skill.

18. Contractors

We may use employees, contractors or appropriately qualified service providers to perform services on our behalf.

19. Weather and Unforeseen Circumstances

We may postpone services because of:

  • Severe weather
  • Natural disasters
  • Emergencies
  • Unsafe conditions
  • Road closures
  • Government restrictions
  • Other circumstances beyond our reasonable control

We will attempt to reschedule affected bookings where reasonably practicable.

20. Privacy

Personal information collected in connection with enquiries, bookings and services will be handled in accordance with our Privacy Policy.

21. Changes to These Terms

We may update these Terms & Conditions from time to time.

22. Governing Law

These Terms are governed by the laws applicable in the Australian State or Territory where the service is provided.
